Terms of Service

1. Who We Are

PlotForge™ ("PlotForge," "we," "us") is a product of Forge IP Holdings LLC, a Missouri limited liability company located in Villa Ridge, Missouri. Contact: kent@forgeipholdings.com.

2. Acceptance of These Terms

By creating an account, checking the agreement box on the sign-up form, or using PlotForge in any way, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use PlotForge. If you use PlotForge on behalf of a company, you represent that you have authority to bind that company to these terms.

3. What PlotForge Does

PlotForge is a browser-based tool that generates to-scale plot plans (single-parcel permit drawings) from a street address. It retrieves parcel geometry from public county GIS services, renders it to scale, lets the operator place and size structures, and exports drawings (PDF, PNG, DXF). The drawing is deterministic — it reflects real GIS geometry plus what the operator draws. The operator, not PlotForge, is responsible for the accuracy and completeness of everything placed on the plan.

4. Not a Survey; Not Professional Services

PlotForge output is reference-grade, derived from public GIS records, which may contain errors, omissions, or out-of-date geometry. PlotForge output:

• is not a boundary survey, ALTA survey, or any other form of legal survey;
• does not establish, certify, or guarantee property lines, easements, or setbacks;
• is not engineering, architectural, land-surveying, or legal advice or services.

You are responsible for verifying that your building department or permitting authority accepts a non-certified plan, and for obtaining stamped/certified documents where required.

5. Accounts and Access

Account requests are reviewed and activated by Forge IP Holdings. We may grant, deny, suspend, or revoke access at our discretion. You are responsible for your credentials and for all activity under your account. Accounts are for a single operator; do not share credentials.

6. Acceptable Use

You agree not to: (a) use PlotForge for any unlawful purpose; (b) misrepresent PlotForge output as a certified survey or stamped professional document; (c) probe, scrape, copy, decompile, disassemble, or reverse engineer the software; (d) resell, sublicense, or provide access to PlotForge to third parties without our written agreement; (e) interfere with the operation or security of the service.

7. Intellectual Property — Patent Pending

All software, designs, methods, and content of PlotForge are owned by Forge IP Holdings LLC and protected by patent (pending), trademark, copyright, and trade-secret law. No license is granted to you other than the limited right to use the hosted service for generating plot plans for your own projects. Unauthorized copying, reproduction, redistribution, or reverse engineering of the software or its methods is prohibited and may result in legal action.

8. Your Drawings and Data

You own the drawings you export. Drawing geometry is generated in your browser; we do not claim ownership of your project content. You are solely responsible for the accuracy of operator-entered information (structure sizes, placements, labels, title-block data) and for the use of exported documents in permit submissions.

9. Third-Party Data Sources

PlotForge retrieves data directly from third-party services, including county GIS parcel endpoints and Esri geocoding and aerial imagery services. We do not control and are not responsible for the availability, accuracy, or licensing of third-party data. Parcel geometry and aerial imagery may be misaligned, outdated, or unavailable for a given location.

10. Fees

Access to PlotForge may be subject to fees communicated at or before activation. We may change pricing prospectively with notice. Fees are non-refundable except as required by law or expressly agreed in writing.

11. Disclaimer of Warranties

PLOTFORGE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GIS DATA WILL BE ACCURATE OR CURRENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORGE IP HOLDINGS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, PERMIT DENIALS, CONSTRUCTION DELAYS, OR REWORK COSTS, ARISING FROM OR RELATED TO YOUR USE OF PLOTFORGE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Forge IP Holdings LLC from claims arising out of your use of PlotForge, your permit submissions, your violation of these terms, or your violation of any third party's rights.

14. Termination

We may suspend or terminate your access at any time for violation of these terms or misuse of the service. Sections 7, 8, and 11–13 survive termination.

15. Governing Law

These terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules. Exclusive venue for disputes is the state or federal courts located in Missouri.

16. Changes to These Terms

We may update these terms from time to time. The effective date above reflects the current version. Continued use after changes constitutes acceptance.
